The Man from Out-of-Town

At the time of the Shulchan Oruch a regulation was made in a town that a man from out of town could not marry in case he dies without children and his wife would be tied until released by his brother.


A man from out of town takes an oath that he has no brothers, and is allowed to marry. He dies without children but there are reasons to suspect that he did indeed have a brother. Can his widow remarry?
